    1. Agreement to terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you and Kinected Solutions LLC ("we", "us", or "our") governing your access to and use of our website, services, and products. By accessing or using our services, you agree to be bound by these Terms.

    2. Our services

    Kinected Solutions LLC offers strategic advisory and leadership advisory, AI integration, application and mobile development, system integration, and product prototyping. The specific scope, deliverables, and fees for any engagement are defined in a separate written agreement. Our services are subject to change and may be modified at any time.

    3. User accounts

    Some of our services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

    4. User conduct

    When using our services, you agree to:

    You retain ownership of any content you submit to our website or services ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing and promoting our services.

    You represent and warrant that you own or have the necessary rights to the User Content you submit, and that the User Content does not infringe or violate the rights of any third party.

    7. Disclaimer of warranties

    YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

    8. Limitation of liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINECTED SOLUTIONS LLC AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

    IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US, IF ANY, FOR ACCESSING OR USING OUR SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

    9. Indemnification

    You agree to indemnify, defend, and hold harmless Kinected Solutions LLC and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your violation of any rights of another.

    10. Termination

    We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use our services will immediately cease.

    11. Governing law

    These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Collin County, Texas for the resolution of any disputes.

    12. Changes to Terms

    We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
